Is Tax Voluntary ? The Australian Taxpayers’ Charter states that the tax obligations of Australians is based on a system of voluntary compliance. Can you find legislation stating that taxation is compulsory? If you can, please let us know.

BEING COOPERATIVE (Page 17)
We prefer to work with you cooperatively, providing you with help to meet your
obligations voluntarily
. However, if you are uncooperative or obstructive, we may need
to take firmer action. For example, we have formal access and information gathering
powers that we use if necessary. People who are obstructive may even be prosecuted.
We ask that you treat us with the same courtesy, consideration and respect we are
expected to give you. If we are subjected to rude or abusive behaviour, we may end
an interview or phone call.

06 Being cooperative in your dealings with us

The tax system is based on taxpayers complying with the tax laws voluntarily
and cooperating with us. This allows us to run the tax system at a relatively low

cost to the community and minimises unecessary intrusion into your affaisr and
those of third parties.

We prefer to work with you cooperatively, providing you with help to meet your
tax obligations voluntarily.
However, if you are uncooperative or obstructive,
we may need to take firmer action. For example, we have formal access and
information gathering powers that we use if necessary. People who are
obstructive may even be prosecuted.

We ask that you treat tax officers with the same courtesy, consideration and
respect they are expected to give you. If tax officers are subjected to rude or
abusive behaviour they may end an interview or phone call.

    Macquarie Bank stated they do not on-sell aussie mortgages..

    it also says People who are obstructive may even be prosecuted.. I have a tax bill from last year can they prosecute me? How do you define obstructive?

    Does it say in the Act that tax is voluntary? Anything on the government website is merely an interpretation of the law or an opinion of an Officer.

    Really? Even if that says what you think it does (which it doesn’t) it’s not the law. No court is going to be bound by this little snippet from a web page. Pinning your hopes on this one sentence is going to end up costing you in the end.

    I agree with Adam!
    I am completely against taxation by coercion – which is what we have here in Australia. and elsewhere in the ‘west’.
    It’s coercion because if you do not agree with paying tax or with paying as much tax as the ATO deems you should be paying, then they will – under the threat of violence – force you to pay that tax money with penalties and interest and God knows what.

    If there is a path to beating the ATO by using the Australian Constitution and other bits of legislation as this article leads one to believe is possible, then why is this not a well trodden path with cases having been won and a precident having been set?

    Why are people going to jail on a daily basis and having their property forcefully removed from them by jackbooted government thugs for not paying tax if it is supposedly voluntary?

    If it is voluntary, why the big secret??

    To my mind the only practical way is to elect a libertarian government which has as its OFFICIAL POLICY to have a small government footprint – thus not requiring massive taxes to support big government!

    Neil you are spot on. Taxation = Control. The biggest problem in reducing the ATO to zero or at least minimal size is that the Public Service would go out on strike, and we all know – or should – that THEY run the country. It should never be allowed to come to this, but there it is.

    and cooperating with us”. well please tell me where I can find copies of the “tax laws”. All laws are based on voluntary cooperation and you subject yourself to them and consent to be ruled by those laws by not verbally or otherwise disagreeing with them (silence equals consent)unless you claim sovereignty for yourself as a human being under GOD.I think its in the UN declaration of human rights “all men are equal under god”.
