		<description>I am not sure about State law. this is delegated from the Constitution and is enforceable by the Police service. that delegation though, cannot be re delegated (Acts interpretation Act)....the States cannot re-delegate the power to create laws, such as the by-laws we all find frustrating (swimming pool fencing). So when confronted by an officious Local Council employee who is determined to ruin your day, one has to just accept the summons or  &#039;spot fine&#039; and appear in court. This does not give the Council a chance to withdraw and perhaps someday they will fight and lose.
Then you have your precedent!</description>
